Privacy Policy for the e-mobility App

The aim of this privacy policy for our Weidmüller e-mobility App (“app” or “software”) is to inform you about the ways in which we will process your personal data and the scope and purposes of such processing. We take the protection of your personal data very seriously and comply with all the applicable data protection provisions, particularly those stipulated in the General Data Protection Regulation (“GDPR”), the Federal Data Protection Act (“BDSG”) and the German Act on Data Protection and Privacy in Telecommunications and Telemedia (“TTDSG”). We will only start processing your personal data when you have had the opportunity to acknowledge this privacy policy.

1. Controller and service provider The app “provider”, as defined in the TTDSG, and the “controller”, as defined in the GDPR, is Weidmüller Interface GmbH & Co. KG (Klingenbergstraße 26, D-32758 Detmold).

2. Data protection officer Our data protection officer is Dr Karsten Kinast (LL.M KINAST Rechtsanwaltsgesellschaft mbH, Hohenzollernring 54, D-50672 Köln). If you have any questions regarding data protection, please do not hesitate to contact our data protection officer at any time, preferably via email: datenschutz@weidmueller.de.

3. General information about the app The app offers you a convenient way to manage your WM Wallbox (e.g. to start and stop a charging process). The exact specifications of our app are detailed in our terms of use.

4. Personal data “Personal data” means any information that can be uniquely associated with you (e.g. your name, email address, home address, gender, date of birth, telephone number or age). By contrast, non-personal data includes information such as the number of people who use an app.

5. Processing of personal data “Processing” means any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transfer, dissemination or other means, alignment, combination, restriction, erasure or destruction.

6. Installation Our app is provided free of charge. You can download it from third-party distribution platforms such as the Google Play Store and the iTunes App Store. To do this, you may need to register with one of the distribution platforms. We have no control over the data processing that may have to be performed by your chosen distribution platform in this context. We are not party to any agreement with the distribution platforms. Your chosen distribution platform will be solely responsible for processing your personal data during the installation.

7. Optional information You have the option of personalising your charging cards within the app. However, this information is not required for you to use the VM Wallboxes or the app.

8. Usage and statistical data during installation If you install the app, the app stores will process anonymised usage and statistical data. This data may be made available to us by the app stores so that we can see how often our app has been downloaded, how long it takes to download the app and similar information. This data will be completely erased when you uninstall the app.

9. Deletion You can remove the app from your device at any time by deleting it. If you do this, all data stored within the app will also be irretrievably deleted.

10. Necessary (device) permissions If you would like to use the app’s features, you will have to allow the app to access certain functions of your device and give the app the relevant permissions. When using the features you require, you will be asked whether you would like to grant the app the relevant access rights. You can view and edit the permissions you have granted at any time on your device. The app currently only requires a Bluetooth connection between your WM Wallbox and device or your WM Wallbox and device have to be in the same network.

11. Use of cookies Our app uses cookies and similar pieces of technology. Cookies are small files that will be sent to your device and stored there when you use the app. We would not be able to offer certain features of our app without using technically necessary / essential cookies. Other / functional cookies, on the other hand, enable us to perform various forms of analysis. These cookies help to make our app more user-friendly and effective for you, as they allow us to see how you use the app and determine your preferred settings. If third parties process information using cookies, they will collect the information on your use of the app themselves. If you would like to see which cookies and similar pieces of technology are used, please refer to the further information – particularly on the purposes of processing, the legal grounds and the personal data processed – in your cookie settings. We use the consent management platform provided by Usercentrics GmbH (Sendlinger Str. 7, D-80331 München) for our cookie settings. We have concluded a data processing agreement with Usercentrics in accordance with Art. 28 GDPR. We divide the cookies used into “essential” and “functional” cookies.

12. Data transfer to third countries Your data may be transferred to third countries (i.e. countries outside of the European Union or European Economic Area) if this is necessary to provide you with services, if we are legally obliged to do so, or if you give your consent. We may also pass on your personal data to processors based in third countries. Please note that an adequate level of data protection is not ensured in all third countries according to the European Commission. We will only pass on your personal data to third countries if this is permitted under Art. 44 – 49 GDPR. Insofar as data transfers to third countries are based on appropriate safeguards in accordance with Art. 46 (2) GDPR (e.g. standard contractual clauses or binding corporate rules), we will take additional technical and/or organisational measures if this is necessary to ensure the adequate protection of your personal data.

13. Data security We have taken technical and organisational measures to protect your (personal) data, particularly to prevent it from being accidentally or intentionally manipulated, lost, destroyed or accessed by unauthorised third parties. Our security measures are constantly adjusted in line with technical developments.

14. External service providers and non-disclosure of data to third parties The external service providers we use to provide our services and operate our app are named in this privacy policy and in our consent management platform. We will not pass on your data to third parties unless we are legally obliged to do so (e.g. to comply with a court order).

15. Your rights You have the following rights under the GDPR. However, we would like to point out in advance that we will only be able to honour the following rights of data subjects to a limited extent due to the small amount of personal data processed.

15.1 Right of access (Art. 15 GDPR) We will be happy to confirm whether we are processing your personal data, which specific data we are processing and for what purposes it is being processed.

15.2 Right to rectification (Art. 16 GDPR) We will rectify any incorrect data that may be stored with us.

15.3 Right to erasure (Art. 17 GDPR) If you would like your personal data to be deleted, we will honour your request as far as this is legally possible.

15.4 Right to the restriction of processing (Art. 18 GDPR) If you would like the use of your personal data to be restricted, we will honour your request as far as this is legally possible.

15.5 Right to data portability (Art. 20 GDPR) If you request the return of the personal data you have provided to us, we will return it in a structured, commonly used and machine-readable format; alternatively, you may ask us to transmit your personal data to another controller in the same format. However, we will only be able to offer the latter option if this is technically possible.

15.5 Right to withdraw consent (Art. 7 (3) GDPR) If you would like to withdraw any consent you have previously given, we will honour your request accordingly. If you withdraw your consent, however, this will have no bearing on the lawfulness of any data processing performed in the past.

15.6 Right to object (Art. 21 GDPR) If we are processing your data on the basis of our “legitimate interest”, as specified in point (f) of Art. 6 (1) GDPR, you may object to the further processing of your data. If we are processing your data for direct marketing purposes, you have a general right to object. If we are not processing your data for direct marketing purposes, your objection must be based on grounds relating to your particular situation.

15.7 Right to lodge a complaint with a supervisory authority (Art. 77 GDPR) You have the right to lodge a complaint with the competent supervisory authority if you believe that the processing of your personal data constitutes a violation of your rights under the GDPR.

16. Contact details to assert your rights as a data subject If you contact us by email (datenschutz@weidmueller.de) or by post (Weidmüller Interface GmbH & Co. KG, Klingenbergstraße 26, D-32758 Detmold), we will store the data you provide (e.g. your email address, name and telephone number) to answer your questions and process your enquiry. We will delete the data obtained in this context as soon as it no longer has to be stored, or we will restrict its processing if we are unable to delete the data due to our statutory retention obligations.

17. Automated decision-making / profiling We will not use any automated decision-making or profiling (automated analysis of your personal circumstances).

18. Changes to this privacy policy As we may have to amend our privacy policy to accommodate changes in the law or changes in our operational processes, we advise you to read this privacy policy regularly. You can always find the latest version of this privacy policy in the “More” and “Privacy” sections of the app.
